Urban Acro – Waiver, Participation & Cancellation/Refund Agreement

1) Definitions
- Company
- Flying Toaster GmbH, trading as Urban Acro or Urbanacro, its owners, employees, coaches, volunteers, and agents.
- Activities
- All classes, workshops, open trainings, rehearsals, showcases, and related events organised by the Company at any venue or outdoors.
- Participant / I
- The adult participant booking for themselves.
2) Voluntary Participation & Health
I confirm that I am voluntarily participating in the Activities. I am in good health, have no medical condition that would make participation unsafe, and have consulted a qualified healthcare professional where appropriate. I will inform the Company of any injuries, conditions, or changes to my health that may affect my participation.
3) Assumption of Risks (Inherent to Acrobatic Activities)
I understand that acrobatic, partner-acro, handbalancing, stretching, and related movement disciplines involve inherent risks that cannot be eliminated, including but not limited to: falls; loss of balance; joint or musculoskeletal injuries; head injuries; equipment failure; inadequate or incorrect spotting by partners; collisions with persons or objects; surface hazards; weather and outdoor conditions for any outdoor sessions; dehydration; and actions or omissions of other participants. I knowingly and freely assume all inherent risks associated with the Activities and with using the facilities and equipment.
4) Safety Rules & Participant Duties
- Follow all safety instructions of coaches and staff.
- Use equipment only as instructed and report defects immediately.
- Do not participate under the influence of alcohol, drugs, or medication that impairs judgement.
- Remove jewellery and secure hair/clothing.
- Act responsibly toward partners and other participants.
- Stop and inform a coach if you feel pain, dizziness, or unsafe.
5) Release of Liability (ordinary negligence only)
To the maximum extent permitted by Swiss law, I hereby waive and release the Company from liability for ordinary negligence for property damage or personal injury arising from my participation in the Activities, including travel to and from the venue. This release does not exclude or limit liability for wilful intent or gross negligence and does not waive any non-waivable statutory rights under Swiss law.
6) Indemnity for My Own Acts
I agree to indemnify and hold the Company harmless from claims by third parties to the extent such claims arise from my own conduct in breach of this Agreement or of the safety rules.
7) Medical Treatment & Emergencies
If I am injured or become ill during the Activities, I consent to first aid being provided by trained staff and to the arrangement of emergency medical treatment if reasonably considered necessary. I understand that medical professionals will treat me only with my informed consent where I am capable of judgement, and in emergencies according to applicable law. I am responsible for any resulting medical costs.
8) Personal Property
I am responsible for my personal property. The Company is not responsible for loss, theft, or damage to personal items, except where caused by wilful intent or gross negligence of the Company.
9) Photography, Video & Marketing Consent
I acknowledge that photos or videos may be taken during Activities. I

Personal data we process (minimum necessary): participant name, email address, phone number; booking and attendance records; payment confirmations from our provider; incident reports where applicable; and—if you opt in—photo/video media for promotional use.
Purposes & legal bases: performance of the class booking and attendance contract; legitimate interests in safe operation and incident logging; consent for marketing (photos/videos, newsletters if you subscribe).
Recipients: service providers (booking, communications, and payment platforms) under contract; insurers or authorities if legally required.
Retention: booking/attendance/payment records kept for statutory limitation and accounting periods; incident records for the limitation period; marketing media until consent is withdrawn.
Your rights: access, rectification, deletion, objection/withdrawal of consent, and data portability where applicable. Contact hello@urbanacro.com.
11) Minors (under 18) – enrolment via adult booking
Classes are generally intended for adults. If a minor participates, the booking account holder (18+) confirms they are the parent/legal guardian or have the parent/guardian’s authorisation to enrol the minor and accept these terms on their behalf. The Company may ask to verify this at check‑in. Where this cannot be confirmed, participation may be refused.
12) Governing Law & Venue
This Agreement is governed by Swiss law. Exclusive venue is the competent courts of Zurich, Switzerland (subject to any mandatory consumer jurisdiction rules).
13) Severability & Entire Agreement
If any provision is invalid or unenforceable, the remaining provisions remain in effect. This Agreement (together with any house rules and booking terms referenced at enrolment) constitutes the entire understanding regarding participation in the Activities and supersedes prior understandings on the same subject.

15) Cancellation & Refund Policy (Classes)
Product types
- Drop‑in Class: a single dated class.
- Cycles: a bundle of 4 consecutive dated classes.
Windows
- You may cancel your cycle or drop-in place not later than 24 hours before the class start time. You can do this directly via your Urban Acro profile.
- For paid bookings, you may request a refund no later than 6 hours beforethe class start. You can do this directly via your Urban Acro profile.
- Only the booking account holder can make changes.
- Refunds or cancellations done via email can take up to 5 days to be processed.
Cancellations (unpaid reservations)
If your booking is unpaid/reserved, you may cancel up to 24 hours before the class start to release your spot. No payment is due.
Refunds (paid bookings)
- Drop‑in Class: within the 6‑hour window, you may request a refund of that session (100% of the price paid for that class).
- Cycle: within the 6‑hour window, you may request one session refund per series (i.e., 1 of 4). The refunded amount equals total paid ÷ 4 (rounded to two decimals). Further refunds under the same cycle are not available.
- Refunds are stored as credit to be used on a next booking. You can request a refund by Bank Transfer to hello@urbanacro.com.Processing times depend on your payment provider and could come with a fee.
After the deadline & no‑shows
- Cancellation requests made inside 6 hours of the class start are not eligible.
- Refund requests made inside 6 hours of the class start or after the class has taken place are not eligible.
- No‑shows are not refundable.
If we cancel
If Urban Acro cancels a class, you may choose a replacement date, an account credit, or a refund of the affected class.
